Potential legal issues for a home owner attempting to short sale their home

Did you know that a homeowner who put false information on their loan application (liar loans) will potentially be up against fraud by the lender they are trying to negotiate a short sale through. Some lenders are now matching 1040's with the original loan application. If there is a discrepancy, the lender can pursue the homeowner for fraud.

It is important to make sure we are asking the right questions. Do not be afraid to ask them on your listing appointment: "Did you falsify information on your loan application"? You want to be able to give them the reality of their situation. . You want to be able to take the listings that make sense and  do not waist your time or put your clients in a much worse situation. More referrals will come out of telling them the truth instead of taking the listing to have that sign in your backyard.

Once a month I meet with my real estate attorney to keep up to date with new laws and legal issues he is seeing and what to avoid when negotiating a short sale. There are many things we need to be aware of as agents to protect ourselves and our clients.

I specialize in short sale negotiations. I am happy to take on that responsibility for you. I can help you pre qualify your clients, (They are your clients, not mine) I will do all back office and negotiations, I will coach you along through the whole process.
