Special contract to be used in short sale transaction

"Did you know" if a buyer puts an offer on a home that 1.  Has an NOD recorded against the property, 2. Buyer will not be occupying the property and 3. Buyer will be "LEASING"  back to the current home owners that are in default, An NODPA (Notice of Default Purchase Agreement) must be used.

 

This is very important  (Buyers Agents) to remember before writing up the offer. This is a procedure that has to be followed to be in compliance. Listing agents, make sure a buyers agent submitting an offer on one of your short sale listings that fits this scenario is giving you the right contract.
